Daily Fantasy Sports - My Take On The Gambling Question

Several years ago I wrote an article about how fantasy sports is not gambling. Back at that time there was basically no such thing as daily fantasy sports (DFS). When DFS took off it felt like things weren't quite right. I just couldn't really tell, "is this gambling" or this a "game of chance". Over the long haul of a season I still feel that it's a no brainer not gambling, but at the microlevel of one night? Well I was sufficiently unsure that I was actually forced to err on the side of caution with respect to the content of the ads I show on this site and others that I own. I'll talk about that for a minute below since it definitely affects the potential earnings of this site and because - people like getting insight into how people can make money on the web. You'll get a tiny bit of information about the decisions I have to make just for the site to survive.

Google has a "no gambling links" policy as part of their TOS for web publishers who want to utilize the adsense platform. I don't know if it's a moral thing for them or what, but they don't allow it. There's a whole list of things they won't allow and that list seems reasonable. But then there's the things they do allow. For example, some of you who haven't been here a long time know that in the beginning I used to not filter ads. But now I no longer allow dating site ads. Why? I want SignAndTrade to be family friendly and for your to not have your wives, kids, or bosses looking over your shoulder wondering why Hubby / Daddy / Employee has inappropriate pictures all over his screen. Google has no problem with those ads and somewhat amusingly, I get regular notifications that I could increase my revenue by "58%" (yes, that much) if I would enable "dating ads". I don't plan to do it, but that's the kind of thing I'm up against. Google basically says "you can't do gambling TEXT related ads, but we'll furnish you a highres inappropriate cartoon for an ad and even suggest you show it to make more money after you've specifically asked us not to display it"! Gotta love it. Now, if your site gets banned because your break the TOS then you're out your current balance and you may lose a substantial amount of time trying to get your account out of suspension. Good luck eating, or buying beer, or whatever it is you do with your earnings while they're holding your money and preventing you from making more. Note: This isn't a complaint, I think the concept behind the policy is good as it weeds out a bunch of junk publishers, but I just find it funny some of the decisions they've made... or not made. Leading us to DFS.

At some point in 2012 or 2013 I was contacted by fanduel and offered the opportunity to become an affiliate of theirs. I accepted, but as you will see never really got into it. Basically you'd get a link or code from me and then sign up with FanDuel using thate special code or link. In doing so you'd get some free money to play games with and I would get to keep some portion of your entry fees for games that you played. It was a VERY reasonable offer they had, but there was a problem, it just didn't quite pass the adsense sniff test. It might be something I couldn't actually advertise on my sites because there was a real possibility that google would ding me for "gambling content" and take away my adsense account. When I contacted google in about utilizing Fanduel banners on a site that I ran adsense on they responded that they were going to have a meeting and discuss the topic to figure out what their official stance was on the topic. I never heard back... leaving me with an understanding that their official stance was that there was no official stance and that by placing fanduel ads on my page I'd be taking a chance on losing my adsense revenue stream. I chose to protect my adsense account and to forego placing Fanduel ads on my sites. I wish I could project what that decision cost me, but considering how Fanduel blew up all huge I may have missed a big opportunity. I'm okay with that and at then end of this article you'll see why.

Here's the deal. I don't know of it's gambling. I don't even think Google knew if it was gambling at the time. I think it's sooooo fuzzy, the line between gambling and not gambling here, that I can understand anyone's argument for whatever side they take in the debate. So we won't argue that, instead let's talk about the recent events and what they mean in the big picture for DFS and the major sports leagues. We'll also talk about why things need to be more locked down and safeguards need to be put in place to protect all the participants in these games.

If MLB is against gambling because it can tarnish the sport, then I can't imagine how they could be on the side of Fanduel, DraftKings, etc and the like. If, as a league, they are worried about bad actors throwing games for an incentive, then without a doubt they must see that there is just as much opportunity for a few players to receive a payoff to have an off night or to simply claim food poisoning or stomach bug or whatever. If the right players can be convinced to not play or simply put up subpar stats - not lose, just put up subpar stats - then it could easily alter who wins a fantasy tournament or game. If someone knew who those players were ahead of time it wouldn't even be a competion any more, it would be a slaughter. If MLB is worried about gamblers getting involved in their game then they should be running like hell from DFS, not buying shares in the places that run the DFS games.

Let's Talk some Means of Cheating at DFS

Generic Aggregate Data
As an employee of a DFS provider one might have access to some pretty good aggregate informaion and possibly even some pretty good detailed information related to players on the game. Given the aggregate data of ownership and a sufficient amount of time one could analyze the data to build strong lineups comprised of top owned players. If they were to get this data and no one else had access to it yet - wow - they'd really have something useful! This method is what they say happened with the recent "cheat" by a DraftKings employee who won on Fanduel.

More specific Data
Now imagine as an employee (or even a malicious user that gains access) that one has access not only to aggregate ownership data while the game was still accepting entries, but that they also have access to information about specific entries. What if they could look at the top 20 best "professional" entrants and know exactly who they chose? Do you think it's conceivable that they could figure out that 80% of them chose Darren McFaddon and use that information to their advantage. Hint: Yes. They were basically just told that the top 20 earners on the site said with
80 percent probability that McFaddon was a good buy at his current contract price. Now who else has high ownership but isn't owned by everyone? They'll just add that little piece of information and bit by bit they'll fit out a lineup that even the top players might go "who in the world would have put those pieces together" with them no realizing that the answer is that they unwittingly advised this DFS genius in that direction.

Eliminating Competition by prior Knowledge
I'm sure this never happens. But if, as an employee, someone got information before it is sent out to all the other participants then they've got an advantage. If injury information comes across their desk before it gets published then they've got a leg up on everyone else. Maybe it's just news that will affect a game - Derrick Rose will miss tonights game because he was at the supermarket shooting a commericial and slipped on a banana peel. If they get that information before ANYONE else does then AT A MINIMUM they've got time to react better than anyone else can.

This should be the MLBs major fear if their worried about the games themselves being tarnished. This is more nefarious that just having information no one else has, but it's a legitimate concern nonetheless. What if our bad actor run some analysis and finds that there is 1 player that is majority owned by the bestplayers? What if they could somehow eliminate that player from the list of possible players they'd want to choose from? Well, if you knew who wasn't going to play and no one else knew that then you'd probably have a leg up - especially if that player was a popular pick. Now imagine that our bad actor is really a bad dude. The payout on some of these is 300k+... that's a lot bigger than many game checks of the athletes. Maybe a player could be convinced to be a game time scratch thus guaranteeing all of the competition would receive zero fantasy sports for that player and they would essentially be eliminated from the tournament. If our bad guy could find two highly utilized players and manage to do that same thing to both on during the same fantasy tournament then they might only be going against 20% of the lineups that they would normally have gone against.

Perhaps one can eliminate a player via other means. I'll leave this to your imagination, but I'll tell you that we're talking a lot of money - according to Fanduel $75 million a week paid out, so we're not talking chump change. When there's that much at stake if someone can gain an advantage, there's that much incentive for extra actors to be involved.


So what does it all Mean?
In the end, the recent shenanigans have caused a stir in the industry and it probably won't go away soon. I don't think the leagues should be doing ANYTHING to support the DFS industry. Major Sports Leagues, let them be them and you be you. If you benefit from them being them then fine, but don't get mixed up in it. Once people start gaming the system it's just going to snowball and you don't want to be in front of that thing as it rolls down the hill.

As for me and my house, I will still not be posting ads to these sites. If nothing else because they are very close to the edge. As someone who's very aware of my own "addictive personality" I'm not really a big fan of introducing people to things that even might be gambling or negatively addictive. I know the excitement I get from playing DFS (even setting a lineup is fun) and because I am so acutely aware of that and of my own psychological make up I have rules to keep things from getting out of hand. I also know from people I am close to that gambling is addictive. Now the APA even says that in the brain it looks a lot like drug addition.

Since there is no limit to the amount of money that could be lost if it turned into a problem and since the DFS sites make it sooooooo easy to deposit funds from a credit card into your bankroll then I'm quite ok with the idea of not advertising for DFS. As for the question of is it gambling. There is no doubt - if you're not skilled at fantasy or if you're playing against cheaters... then you are gambling. If you are skilled and analytical then I would understand your argument that YOU are not gambling, but there's a better than 50/50 chance the guy who's money you're taking is doing exactly that. Do with that information what you will.

I think it should be legalized and codified and whatever legalese needs to happen to make sure it isn't banned. The undeniable fact is that it's fun for the people that like it, and people who want to compete should be able to do so. At the same time in with its current lack of oversight / regulation I have no doubt that there's a wave a problems on the horizon related to DFS losses (think drained bank accounts trying to win big) and new destructive addictive behaviors that nobody sees coming until we're standing in the middle of it. For that reason, I think it should be placed under whatever rules that the casinos have relating to looking out for people engaging in what can be flagged as addictive and destructive behavior. With some safeguards in place and lots of visibility into what is happening I think it's a great product for fans that want to be involved with it.
